Termination & Refund Policy
Our Cancellation and refund policy is only applicable if you make your intentions known to us, within 15 days from the date your service has gone live. You will also only be eligible for the cancellation and refund if your cancellation request falls under the below-mentioned guidelines. We reserve the rights to reject any cancellations when the these conditions are not met.
Termination
Either party (the "Non-defaulting Party") shall be able to terminate this Contract immediately in the event that the other:
- Commits a material breach of any of its obligations under this Contract and has not remedied such breach (if capable of remedy) within 30 days of request from the Non-defaulting Party for remedy by serving written notice; or
- Is subject to any winding up order or resolution, has any provisional liquidator appointed to it, has a receiver appointed or is the subject of an application made to court for an administration order or if a notice of intention to appoint an administrator is filed or an administration order made in respect of it, is unable to pay its debts within the meaning of Section 123 of the UK Insolvency Act 1986, enters into any arrangement for the benefit of or other compounds with its creditors generally or ceases or threatens to cease carrying on its business, or (being an individual) is the subject of a bankruptcy petition or order, or any equivalent processes in any jurisdiction.
- Without prejudice to any rights that have accrued under a Contract or any of its rights or remedies, either party may terminate a Contract on giving not less than 30 days written notice to the other party. At our discretion we may accept requests to terminate Services in situations where you provide us with less than 30 days notice. You may be required to submit a cancellation request in the client area in order for us to process your cancellation. Notwithstanding the foregoing, if you have agreed and paid for Services on an annual or multi-year payment basis, we shall not be obliged to refund any pro rated payments if you cancel during the annual or multi-year term.
- In accordance with our Service Acceptable Use Policy, an account may be terminated by us unilaterally, without notice and at our discretion if we consider an account holder to be in breach of the stated prohibited uses.
Refund
Products purchased from Cobimex Hosting may be refunded only if canceled within 30 days of the date of the transaction.
Note: Due to their nature, cryptocurrencies, tokens and digital assets are generally irreversible and their exchange rates are highly volatile and transitory. We can not be responsible for any risk including but not limited to exchange rate risk and market risk. Products purchased using cryptocurrencies, tokens or digital assets will not be refunded.
Note: If a client's actions are found to violate applicable laws or Cobimex Hosting's Terms of Services, any payments made to Cobimex Hosting will not be refunded.
"Date of the transaction,” for the purpose of this Refund Policy, means the date of purchase of any product or service, which includes the date any renewal is processed by Cobimex Hosting in accordance with the terms and conditions of the applicable product or service agreement (Terms of Use). You may cancel a product at any time, but a refund will only be issued if cancellation is requested within the refund timeframe specified for the applicable product, if available at all. Note: Some products have different policies or requirements for a refund associated with them, including some products that are not eligible for a refund under any circumstance. Please see below for refund terms applicable to such products:

Chargebacks
If at any time, we record a decline, chargeback, reversal, payment dispute, risk of payment fraud or other rejection of a charge of any payable fees on your Cobimex Hosting account (“Chargeback”), this will be considered as a breach of your payment obligations hereunder, therefore you agree that we may pursue all available lawful remedies in order to obtain payment, including but not limited to, immediate termination, without notice to you, of your Cobimex Hosting account and any domain names or Cobimex Hosting services registered or renewed on your behalf (“Services”). In addition, this will also result in disabling the option to checkout with a credit card for your Cobimex Hosting account to limit the risk of payment fraud.
In the event a Chargeback is performed, your Cobimex Hosting account may be blocked without the option to re-purchase or re-use it, and any data contained in such a Cobimex Hosting account, including any certain content, features, or capacity of your Cobimex Hosting account may be subject to cancellation and loss of data.Cases related to criminal fraud chargebacks or obvious payment fraud (i.e. cases where compromised credit card details or Paypal account were used to make purchases) will result in permanent service termination without any option to recover.
If you have any questions or concerns regarding a payment made to Cobimex Hosting, we encourage you to first contact our Customer Support team before filing a Chargeback or reversal of payment, in order to prevent the Cobimex Hosting Services from being canceled and your Cobimex Hosting account being blocked, and to avoid the filing of an unwarranted or erroneous Chargeback, which may result in your being liable for its applicable fees, in addition to re-payment of all the fees applicable to the Cobimex Hosting Services purchased (and charged-back) by you.We reserve our right to dispute any Chargeback received, including by providing the relevant credit card company or financial institution with any information and documentation proving that the User responsible for such Chargeback did in fact authorise the transaction and make use of the Services rendered thereafter.
