Cobimex Hosting (part of Cobimex Limited ) understand that we have a responsibility to protect and respect your privacy and look after your personal data. Please read this privacy policy carefully as it contains important information on who we are and how and why we collect, store, use and share your personal data. It also explains your rights in relation to your personal data and how to contact us or supervisory authorities in the event you have a complaint.
We collect, use and are responsible for certain personal data about you. When we do so we are subject to the UK General Data Protection Regulation (UK GDPR). We are also subject to the EU General Data Protection Regulation (EU GDPR) in relation to goods and services we offer to individuals in the European Economic Area (EEA).

Information Collected

  1. The personal data we collect about you depends on the particular products and services we provide to you. We will collect and use the following personal data about you, including but not limited to:
    1. your name and contact information, including email address and telephone number and company details
    2. your billing information, transaction and payment card information including your PayPal email address
    3. your username and passwords for our products and services
    4. content of your emails and communications with us
    5. domain name, IP address, access logs
  2. We collect and use this personal data for the purposes described in the sections. If you do not provide personal data we ask for, it may delay or prevent us from providing products and/or services to you.

Information Use

Under data protection law, we can only use your personal data if we have a proper reason, eg:

  2. to comply with our legal and regulatory obligations;
  3. for the performance of a contract with you or to take steps at your request before entering into a contract; or
  4. for our legitimate interests or those of a third party.
  5. A legitimate interest is when we have a business or commercial reason to use your personal data, so long as this is not overridden by your own rights and interests. We will carry out an assessment when relying on legitimate interests, to balance our interests against your own.

We may use cookies and other information-gathering technologies for a variety of purposes, such as providing us with information about how you interact with our Websites and assisting us in our marketing efforts. Surveys

In order to improve our products and services, you have the possibility to rate us via our partner "Trustpilot" of Trustpilot A/S, Pilestræde 58, 5th floor, 1112 Copenhagen, Denmark. You can submit a rating, for example, as part of a product purchase. The ratings are recorded using an integrated rating form or via a simple link. If you submit a rating via the integrated rating form, we will transmit your name, e-mail address, a reference number (usually your order number) including your rating to Trustpilot as soon as you click on the rating link. The transmission is solely for the verification of your online purchase with us to ensure that it is an authentic review. When you receive a review invitation via the simple link, you will be taken directly to the review form on Trustpilot. Alternatively, you can also rate us at any time via the Trustpilot platform. In order to submit a rating on Trustpilot, the creation of a user profile is required so that it can be published on the portal accordingly.

In the event that you have given us consent to receive "surveys" in the Cobimex Hosting Control Panel, we can send you a corresponding rating invitation with a link to the survey. Third Party Disclosure

In this section, End Users are defined as individuals who visit, access, use and/or interact with our Customers’ websites or email account. When an End User visits a customer website or send/receives email from a customer email address, we process Personal Data contained in server logs. Such Personal Data may include IP address and name of individual (if contained within a domain name or email address).

Storage and access of the data on our servers

We have appropriate security measures to prevent personal data from being accidentally lost, or used or accessed unlawfully. We limit access to your personal data to those who have a genuine business need to access it. Those processing your personal data will do so only in an authorised manner and are subject to a duty of confidentiality. We continually test our systems and our Data Centre is ISO 27001 certified, which means we follow top industry standards for information security.

We also have procedures to deal with any suspected data security breach. We will notify you and any applicable regulator of a suspected data security breach where we are legally required to do so.

Sharing of Your Personal Information

We work with other companies who provide us with services that help run our business and the Cobimex Hosting Service (“Service Providers”). These companies provide services to help us deliver customer support, process credit card payments, manage and contact our existing Customers and Administrators as well as sales leads, provide marketing support, and otherwise operate and improve our Services. These Service Providers may only process personal information pursuant to our instructions and in compliance both with this Privacy Policy, the contracts we have in place with such Service Providers, and other applicable confidentiality, data protection, and security measures and regulations.

Specifically, we do not permit our Service Providers to sell any personal information we share with them or to use any personal information we share with them for their own marketing purposes or for any purpose other than in connection with the services they provide to us.
In addition to sharing with Service Providers as described above, we also may share your information with others in special circumtances.

Term and termination

  1. This Agreement will remain in full force and effect so long as: (a) the Services Agreement remains in effect or the Data Processor provides the relevant services to the Data Controller, or (b) the Data Processor retains any Personal Data related to the Services Agreement and/or the services in its possession or control.

  2. If a change in any Data Protection Legislation prevents either party from fulfilling all or part of its obligations to the other party, the parties will suspend the processing of Personal Data until that processing complies with the new requirements. If the parties are unable to bring the Personal Data processing into compliance with the Data Protection Legislation within 28 days, they may terminate the Services Agreement and/or the provision of services on written notice to the other party without prejudice to any right or remedy the parties may have under the Services Agreement or otherwise.

  3. Any provision of this Agreement that expressly or by implication should come into or continue in force on or after termination of the Services Agreement or the provision of services by the Data Processor to the Data Controller (as may be applicable) in order to protect Personal Data will remain in full force and effect.
